Acceptance of Terms

By accessing or using our digital platform, you acknowledge that you have read, understood, and agree to comply with these Terms of Use. If you do not accept these terms, you must refrain from using our services. Please be aware that most disputes related to this agreement will be resolved through binding arbitration on an individual basis, rather than in court or as part of a class-action lawsuit. This document outlines the terms governing your use of our website, mobile application, and other digital tools (collectively referred to as “Digital Services”), which are operated by Watch-Broker, LLC and its affiliated entities (“we,” “us,” or “our”).

Our platform facilitates watch-related listings and informational resources. However, we do not act as a broker, dealer, or auctioneer and do not participate in transactions involving the purchase, sale, or negotiation of watches. Additionally, we do not own, inspect, or take possession of any watches listed on the platform.

Key Terms and Responsibilities

Acceptance of This Agreement

Each time you use our Digital Services, you confirm your acceptance of these terms and related policies, including our Privacy Notice and any additional guidelines or FAQs that may apply. If we provide services beyond what is described here, these Terms of Use will still govern unless a separate, written agreement states otherwise.

You agree that our platform is solely a facilitator of watch listings and does not govern transactions between users or third parties. Any dealings between buyers and sellers are independent of Watch-Broker.

Your Obligations

  • Ensure that any information you submit on our platform is accurate and up to date.
  • Be responsible for the content you provide in listings or communications.
  • Use our platform in compliance with applicable laws and in accordance with our guidelines under the section “User Conduct and Responsible Use” below.

Intellectual Property Rights

  • Watch-Broker retains all rights to the content, trademarks, software, and intellectual property displayed or used within the Digital Services.
  • You may not commercialize, distribute, or create derivative works using any portion of our platform or its content.
  • If we find that a user repeatedly violates third-party intellectual property rights, we may suspend or terminate their access.

Legal Disclaimers and Liability Limitations

Release and Indemnification

By using our platform, you agree to release Watch-Broker and its affiliates from any claims or disputes that arise between you and other users or third parties.

You further agree to indemnify Watch-Broker against any losses, claims, damages, or expenses arising from:

  • Your use of our Digital Services.
  • Content you provide.
  • Any violations of these Terms of Use.
  • Third-party access to your account.

No Warranties

Our platform and content are provided “as is” without warranties of any kind. We do not guarantee that our services will be uninterrupted, secure, or error-free.

Limitation of Liability

We are not liable for any damages, whether direct or indirect, that arise from:

  • Your use or inability to use the Digital Services.
  • Errors, security breaches, or interruptions.
  • The actions or failures of other users.

In any case, our maximum liability will not exceed $50 or the amount you have paid to Watch-Broker within the last 12 months, whichever is greater.

Third-Party Content and Services

  • Our platform may include links to third-party websites or services. We do not endorse or take responsibility for their content or policies.
  • We participate in affiliate marketing and may earn commissions from certain third-party links.

Account and Platform Usage

Termination of Access

We reserve the right to suspend or terminate your account and restrict access to our services if:

  • You violate these Terms of Use.
  • You misuse your account or our platform.
  • We deem your actions harmful to our users or business operations.

Amendments to These Terms

We may update these Terms of Use at any time by posting a revised version on our platform or notifying you via email. Your continued use of our services constitutes acceptance of the revised terms.

Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of the State of Georgia, USA. Any disputes must be resolved through arbitration rather than litigation, except where intellectual property rights are involved. See Section 24 for detailed arbitration terms.
